New Guidelines for Heirship Certificate: Issued by Revenue Department as per court orders வாரிசு சான்றிதழ் பெற புதிய வழிகாட்டுதல்கள்: நீதிமன்ற உத்தரவுப்படி வருவாய் துறை வெளியிட்டது

சட்டப்படியான வாரிசு சான்றிதழ் பெறுவதற்கும், அதை வழங்குவதற்கும் புதிய வழிகாட்டுதல்களை, நீதிமன்ற உத்தரவின் அடிப்படையில் வருவாய் துறை வெளியிட்டுள்ளது. இதுதொடர்பாக வருவாய் நிர்வாக ஆணையருக்கு தமிழக வருவாய் துறை செயலர் குமார் ஜெயந்த் அனுப்பியுள்ள கடிதம்: 

சட்டப்படியான வாரிசுகளுக்கான வாரிசு சான்றிதழ்களை தாசில்தார் வழங்குவதற்கு, வழக்கின் அடிப்படையில் நீதிமன்றம் உத்தரவிட்டுள்ளது. தமிழக அரசு இதை ஆய்வு செய்து, விரிவான வழிகாட்டுதல்களை வெளியிட்டுள்ளது. அதன்படி, இறந்தவர் வசித்த பகுதியில் உள்ள தாசில்தாரிடம், வாரிசு சான்றிதழ் கேட்டு ஆன்லைனில் விண்ணப்பிக்க வேண்டும். ஒருவேளை, அவர் அந்த முகவரியில் 6 மாதத்துக்கும் குறைவாக வசித்திருந்தால், ஓராண்டுக்கு அதிகமாக வசித்த பகுதியின் தாசில்தாரிடம் இருந்து அறிக்கை பெற வேண்டும். இறந்தவர் திருமணம் ஆனவராக இருந்தால், அவரது தந்தை, தாய், துணை, மகன், மகளின் பெயர்கள் சான்றிதழில் இடம்பெறலாம். திருமணம் ஆகாதவராக இருந்தால், தந்தை, தாய், சகோதரர்கள், சகோதரிகளின் பெயர் இடம்பெறலாம். 

அதே நேரம், இறந்த ஒருவருக்காக வேறொருவர் சான்றிதழ் பெற வேண்டுமானால், இறப்பு சான்றிதழ், 7 ஆண்டுகளுக்கு மேல் காணாத நிலையில் இறந்துவிட்டதாக சம்பந்தப்பட்ட நீதிமன்றம் வெளியிட்ட உத்தரவு, இறந்தவரின் ஆதார், வாக்காளர் அட்டை, பாஸ்போர்ட், வங்கி புத்தகம், ஓட்டுநர் உரிமம், பென்ஷன் உத்தரவு உள்ளிட்ட ஆவணங்களில் ஏதேனும் ஒன்றை சமர்ப்பிக்க வேண்டும். 

 அதேபோல, இறந்தவருடனான உறவு தொடர்பாக, திருமண பதிவுச் சான்று, பாஸ்போர்ட், வாக்காளர் அட்டை, ஆதார் அட்டை, சாதிச் சான்று, ஓட்டுநர் உரிமம், பிறப்புச் சான்று, பள்ளி மாற்றுச்சான்று உள்ளிட்ட ஏதேனும் ஒரு ஆவணத்தை அளிக்கலாம். ஒருவேளை, வயது வந்த வாரிசு இல்லாத பட்சத்தில் மைனர் வாரிசுக்காக பாதுகாவலர், சகோதரர், சகோதரி வாயிலாக விண்ணப்பத்தை சமர்ப்பிக்கலாம். இறந்தவர் குழந்தையை தத்தெடுத்திருந்தால், அவருக்கான வாரிசு சான்றிதழை வழங்குவதற்கு முன்பு, அவர் சட்டப்படி தத்தெடுக்கப்பட்டவரா என்பதை தாசில்தார் உறுதி செய்ய வேண்டும்.

The revenue department has issued new guidelines for obtaining and issuing legal heir certificates based on court orders. In this regard, the letter sent by Tamil Nadu Revenue Department Secretary Kumar Jayant to the Commissioner of Revenue Administration:

The court has ordered the Tahsildar to issue succession certificates to legal heirs on a case-by-case basis. The Government of Tamil Nadu has studied this and issued detailed guidelines. Accordingly, the heir certificate should be applied for online from the tahsildar of the area where the deceased resided. Perhaps, if he has resided at that address for less than 6 months, a report should be obtained from the Tahsildar of the area where he has resided for more than a year. If the deceased was married, the names of his father, mother, spouse, son and daughter may appear on the certificate. If unmarried, name of father, mother, brothers, sisters can be included.

At the same time, if someone else wants to get a certificate for a deceased person, they have to submit any of the documents including death certificate, order issued by the concerned court that they have died after not being seen for more than 7 years, Aadhaar, voter card, passport, bank book, driving license, pension order of the deceased.

 Similarly, any document including marriage registration certificate, passport, voter card, Aadhaar card, caste certificate, driving license, birth certificate, school transfer certificate can be provided in relation to the deceased. Perhaps, in the absence of an adult heir, an application can be submitted for a minor heir through a guardian, brother or sister. If the deceased has adopted the child, the tahsildar must ascertain whether he is legally adopted before issuing the succession certificate for him.
